By accessing or using JobRecall ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
2. Description of Service
JobRecall is a Right-to-Submit (RTS) management platform that connects software developers with recruiters. The Platform enables:
- Developers to control who can submit their resume to job opportunities
- Recruiters to request permission before representing candidates
- Both parties to track submissions and avoid duplicate representations
3. User Accounts
Registration
To use the Platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.
Account Types
- Developer accounts: For individuals seeking job opportunities
- Recruiter accounts: For recruiting professionals and agencies
Account Responsibility
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
4. Right-to-Submit (RTS) Process
The RTS system works as follows:
- Recruiters must request permission before submitting a developer's resume
- Developers can approve or decline RTS requests
- Approved RTS grants the recruiter permission to represent the developer for specific roles
- Developers can revoke RTS approval at any time
- RTS does not guarantee job placement or interviews
5. User Conduct
You agree not to:
- Provide false or misleading information
- Impersonate another person or entity
- Submit resumes without proper RTS approval
- Use the Platform for spam or unsolicited communications
- Attempt to circumvent security measures
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
6. Content
Your Content
You retain ownership of content you submit (resumes, profiles, etc.). By submitting content, you grant us a license to use, display, and share it as necessary to provide the Platform's services.
Content Standards
All content must be accurate, professional, and comply with applicable laws. We may remove content that violates these Terms.
7. Fees and Payment
Free Tier
Basic features are available at no cost with usage limits.
Paid Plans
Premium features require a paid subscription. Fees are billed in advance and are non-refundable except as required by law.
Trials
Trial periods may be offered. At the end of a trial, you will be charged unless you cancel before the trial ends.
8. Intellectual Property
The Platform, including its design, features, and content (excluding user-submitted content), is owned by JobRecall and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Job placement or interview opportunities
- The accuracy of user-submitted information
- Uninterrupted or error-free service
- That the Platform will meet your specific requirements
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBRECALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
11. Indemnification
You agree to indemnify and hold harmless JobRecall from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through your account settings.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except for claims that may be brought in small claims court.
